1. US~Observer SMS Program
Program Name and Description:
The US~Observer SMS Program delivers text message notifications, including but not limited to news updates, promotional offers, event announcements, and service-related alerts, to subscribers who have opted in to receive such communications. We may also send messages to phone numbers obtained from third-party sources (e.g., data providers, public records), provided such sources have obtained prior express written consent from the number’s owner, in compliance with the Telephone Consumer Protection Act (TCPA). Messages may include information about our investigative journalism, subscription offers, or other relevant updates from US~Observer. Users receiving messages from externally sourced numbers will be notified of the source and may opt out as described below.
Opt-Out Instructions:
To stop receiving text messages from the US~Observer SMS Program, reply "STOP" to any message received from our shortcode. You will receive a confirmation message indicating that you have been unsubscribed. After opting out, you will no longer receive SMS messages from this program unless you rejoin.
Rejoining Instructions:
If you have previously opted out and wish to rejoin the US~Observer SMS Program, you may opt back in by texting "START" to our shortcode or by signing up again through our website at https://www.USObserver.com/sms-signup. You will need to confirm your consent to receive messages again.

Carrier Liability Disclaimer:
US~Observer is not responsible for delayed or undelivered text messages. Mobile carriers are not liable for any delays or failures in the delivery of our text messages, as delivery is subject to the operational limitations of your mobile carrier.

Standard message and data rates may apply to all text messages sent or received as part of the US~Observer SMS Program. Please consult your mobile carrier for details about your plan and any applicable charges.

(b) User-Provided Content and Third-Party Links: US~Observer is not liable for any content provided by users or third parties, including but not limited to user-submitted materials, comments, or links to external websites. You acknowledge that US~Observer does not pre-screen or control such content and assume all risks associated with accessing or relying on it.
(c) Force Majeure: US~Observer shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, cyberattacks, governmental actions, or interruptions in telecommunications or internet services.
7. Governing Law and Dispute Resolution
(a) Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Maricopa County, Arizona.
(b) Arbitration and Class Action Waiver: Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in Maricopa County, Arizona, by a single arbitrator. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against US~Observer. Each party shall bear its own costs and attorney’s fees, unless otherwise determined by the arbitrator.
(c) Severability: If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall remain in full force and effect.
8. Entire Agreement and Written Requirement
(a) Entire Agreement: These Terms and Conditions, together with the Privacy Policy, constitute the entire agreement between you and US~Observer regarding the use of the Services and supersede any prior or contemporaneous agreements, communications, or representations, whether written or oral, including but not limited to statements made during phone calls, meetings, or other interactions.
(b) Written Requirement: No verbal agreements, statements, or representations made by US~Observer or its representatives shall be binding unless expressly incorporated into these Terms or another written agreement signed by an authorized representative of US~Observer. All modifications or amendments to these Terms must be in writing and posted on our website or otherwise provided to you in accordance with Section 9.
(c) Use of User Information: US~Observer may use information provided by you, including Personal Information and user-submitted materials, for purposes such as providing the Services, investigative journalism, content creation, analytics, or legal compliance, as outlined in the Privacy Policy. Any statements recorded during phone calls or meetings shall not constitute binding agreements unless expressly incorporated into a written contract.
